Continental Express to Appeal Temporary Injunction Barring Flights Between Love Field and Cleveland
HOUSTON, July 9, 1998 -- Continental Express, Inc. announced today that it and Continental Airlines, Inc. (NYSE: CAI.A and CAI.B)would immediately appeal the issuance today of a temporary injunction prohibiting Continental Express from commencing service between Dallas' Love Field and Cleveland. The service, originally planned to start July 1, was postponed last week after the issuance of a temporary restraining order and pending the outcome of a hearing on a temporary injunction before the 48th Judicial District Court of Tarrant County, Texas. That court issued a temporary injunction against the Cleveland service today. The injunction does not affect Continental Express' service between Love Field and Houston's George Bush Intercontinental Airport, which will continue.
"We're outraged at this abuse of the legal system to prevent competition and deny customers their right to convenient, competitive service. We believe that neither the facts nor the law support today's ruling, and we will continue our fight in the appeals courts, and in separate actions in federal court. We are determined to bring the benefits of competition to the Metroplex and defend our right to fly out of Love Field," said a Continental Express spokesperson. "In the meantime, Continental Express will continue to fly seven daily round trip flights between Dallas Love Field and Houston's George Bush Intercontinental Airport, providing choice and fair competition to travelers in the Metroplex area."
